South Carolina man arrested for DUI with 3 kids in car

In South Carolina, police and prosecutors take all drunk driving charges seriously--even if a driver is barely over the legal limit and it is his or her first offense. This is why it is always important to seek information about your legal rights after a DUI arrest.

Some DUI cases, however, are much more complicated--and have much higher risks--than others. This is the case when a drunk driving arrest stems from an accident causing injury or death, or when a breath test reveals a very high blood alcohol content. Another case in which criminal charges may be upgraded is when children were in the vehicle at the time of the arrest. Earlier this month, a man was arrested in Columbia, South Carolina, with three minor children in the car.

The 51-year-old was pulled over by police because he was allegedly speeding, according to a news report. Once he was stopped, an officer thought he noticed an odor of alcohol and proceeded to administer a field sobriety test.

The man did not perform well on the field sobriety test, according to the arresting officer, and he then submitted to a breath test that recorded a .16 percent blood alcohol content. Of course, the legal limit in South Carolina is .08 percent.

The man told police he had a few beers earlier in the day before heading out to pick up his 13-year-old daughter and her two friends from a cheerleading and gymnastics school. He has now been charged with DUI as well as unlawful conduct toward a child and speeding.

While these charges are very serious, it is important to note that breath tests are not always accurate and an odor of alcohol can exist even if a person only has one drink. After any DUI arrest, it is wise to protect one's rights and work toward the best potential outcome by seeking criminal defense counsel.
