Mistakes to avoid when filing for divorce in January

According to the American Academy of Matrimonial Lawyers, up to 30 percent more couples tend to seek a divorce in January after the holidays have ended. For South Carolina residents who are thinking about doing so, there are some mistakes that they should avoid making.

People should never file for divorce out of anger. Instead, they should treat a divorce as a business deal. Being emotional and aggressive can result in an overly combative situation, which means not only a contentious divorce, but when lawyer fees are considered, a more expensive one than it would have been otherwise.

Parents who have young children should also avoid involving them in the divorce. This includes before and after the divorce and while it is in progress. They should also take care to not speak negatively about the other spouse in the presence of the children. If there is a third party involved, no confrontational contact should be made with that individual as well as his or her spouse or children.

Instead of filing for divorce during the holidays or right before a child's graduation or wedding and have their children forever associate the event with the end of their parents' marriage, individuals should use that time to find a good divorce attorney, preferably one with no association with the family. This may entail interviewing more than one attorney and considering which one is the best listener and is most likely to help an individual achieve the divorce results he or she wants.

There are a variety of divorce legal issues that arise when parents of young children are ending their marriage. Child custody and visitation as well as support are some of them, and in many cases they can be resolved in a more satisfactory manner through negotiations handled by the parents' respective attorneys than if a judge makes these decisions.
