DUI charge for rapper DMX

The rap artist known as DMX was charged with DUI in South Carolina after police stopped him following a tip about a suspected drunk driver. Police say he failed field sobriety tests Drunk driving charges were filed against the musician. He was also hit with charges of not having a driver's license and not using a seat belt.

DMX, whose real name is Earl Simmons, has previously seen convictions and penalties for driving violations and other charges. In 2006 in South Carolina, he was pulled over on suspicion of driving without a license, for which he was taken into custody and paid a fine.

Field sobriety tests are not always accurate. Some medical conditions can cause false positives to occur, and the tests are not always administered correctly. Blood and breath tests are a more reliable way of establishing intoxication. The news reports do not report if DMX was further tested to determine his BAC.

Whether an individual is a rap star or a less-famous name, DWI offenses are serious. The charge may be a DWI first offense or DWI second offense, but stiff penalties may be sought by prosecutors. Adding to the consequences may be allegations that the accused refused a breath test or should be tried for aggravated DWI or felony DWI.
