Man faces felony DUI charges in fatal South Carolina accident

Orangeburg County was the scene of a fatal accident involving two people who were hit while operating motorcycles. At about 7 p.m. on Sept. 2, a 2009 Saturn was traveling south on Route 21 near Wire Road, when the driver presumably crossed the center line of Route 21 and hit two motorcycles operated by a 43-year-old Orangeburg man and a 50-year-old Columbia woman. The bodies of the two riders were identified by the pastor of a Columbia church.

The driver of the Saturn is alleged to have been driving drunk at the time of the accident. In addition, police believe that he was driving on a suspended license when the accident occurred. He is facing several charges, including felony drunk driving charges, in the deaths of the two motorcyclists. Police have indicated that they would continue to investigate the accident.

At a court appearance, the bond amount for the accused was set at $30,000. It was reportedly paid and he was released pending further court appearances. His criminal history reveals a conviction for marijuana possession and disorderly conduct, which may create bias in the court proceedings.

Felony drunk driving charges are a serious matter for any person to face in court. A DUI defense attorney, however, may be able to present a persuasive defense to the charges. The attorneys may be able to assemble a number of defenses to a DUI charge, such as determining the conduct of the police immediately prior to and after the arrest took place and any violations of an accused's rights or improper gathering of evidence.
