Fatal South Carolina car accident leads to DUI charge

A man now faces a felony DUI charge over an accident that killed a woman in Orangeburg. The woman, a 21-year-old from Hickory Grove, was a passenger in the vehicle driven by the accused. The driver is a 26-year-old man from St. Matthews.

From the accident scene, police surmised that the accused drove his truck off the road and collided with several trees. Blood alcohol tests revealed that the accused had more than twice the legal limit of alcohol in his system. The accused was charged with felony DUI after his passenger, the 21-year-old woman, died at the scene of the collision.

Although the incident occurred in September of 2013, the driver wasn't charged with felony DUI until Oct. 14. Whether or not the accused has retained counsel remains unknown.

Drunk driving charges in South Carolina are very serious and can result in severe consequences to the accused. With the help of a qualified DUI attorney, however, it may be possible to devise an effective legal defense strategy before entering into plea negotiations with the prosecutor or going to trial in court. While there may be injuries or property damage in the accident, the central issue in the DUI case may be whether or not the accused was actually intoxicated at the time of the accident. Sometimes police make mistakes in misunderstanding how people perform on sobriety tests or in how they take a sample for a blood alcohol test. Because police often make errors while collecting evidence of intoxication, the defense may be able to use problems with the evidence against the accused in ultimately reducing the charge or in obtaining a dismissal of the DUI charge.
