Woman charged with felony DUI in moped accident

A 30-year-old woman from Myrtle Beach, South Carolina, was taken into police custody on Nov. 10. According to the report, the woman was traveling east on Highway 544 in a 1998 Jeep when she struck another woman on a moped.

The driver of the moped reportedly suffered serious injuries. She was taken to Grand Strand Regional where she remained at the time the report was released. The injuries that she suffered were not reported. The driver of the Jeep and her passenger were not injured in the accident.

The woman was charged by the South Carolina Highway Patrol for felony DUI. It was reported that police officers were still investigating the scene of the accident.

In South Carolina, the punishments for felony drunk driving charges are incredibly harsh. In addition to a jail sentence, the accused individual could potentially face a permanent loss of their driving privileges and hefty fines and court fees. While it was not reported in this case what evidence was collected, officers may conduct a field sobriety test, a breath test or even collect a blood sample to confirm that the person was driving while over the legal limit. In addition, they may use witness testimony to determine if the person actually caused the accident.

While having all this evidence may seem to give the prosecution an advantage, an attorney may be able to help their clients create a strong DUI defense. In some cases, the attorney could potentially challenge any field sobriety test, breath or blood test, especially if they have evidence that these tests were not properly conducted. Further, they may also be able to convince the court that witness testimony is faulty or does not corroborate with police reports.
