Driver faces DUI charge after car wash crash

South Carolina police say that a 29-year-old man was intoxicated when he lost control of his vehicle and crashed into a car wash during the early hours of May 11. The Gray Court resident is facing drunk driving charges due to the alleged results of a blood alcohol test conducted while he was receiving medical treatment. The incident took place at approximately 2:45 a.m. in Travelers Rest.

The Travelers Rest Police Department say that the man was proceeding westbound on Center Street when he lost control of his pickup truck. The truck then crossed the Main Street intersection and struck a car wash on the opposite side of the roadway. Police say that the vehicle collided with the car wash with sufficient force to buckle some of the structure's steel beams.

Emergency response personnel extracted the man from his vehicle and transported him to Greensville for medical treatment. His injuries were not considered serious. Police at the accident scene said that the man smelled strongly of alcohol, and a toxicology test was requested at Greenville Memorial Hospital. Authorities claim that an open bottle of liquor was discovered in the man's pickup truck. He has also been charged with driving with an open container in the vehicle.

A drunk driving case often hinges on the results of a toxicology test performed on a blood or breath sample. A criminal defense attorney may scrutinize the way these tests are performed, and they could seek to have the results ruled inadmissible in certain situations. Breath testing equipment is now extremely sophisticated, but it must be maintained and calibrated correctly for it to provide accurate results. Blood tests may also prove unreliable, and an attorney may challenge their results if the sample used was not collected and handled according to strict procedural rules.
