Man faces felony DUI charges in fatal accident

South Carolina highway officials report that a man was taken into custody on charges of allegedly driving drunk and causing a car accident that claimed the life of a 26-year-old man. The fatal accident occurred about 8:15 p.m. on Dec. 22 in Horry County.

Authorities stated that a 32-year-old Loris man driving a southbound 1998 Ford Explorer collided with a northbound 2007 Jeep Cherokee as the man, who was traveling on Red Bluff Road, veered over into the opposite side of the roadway. In the impact, the Ford driver was injured; however, a male occupant in the Jeep, also from Loris, died from his injuries. It was reported that first responders took the injured Ford driver to a nearby hospital for treatment. It was unknown if the Jeep passenger was also transported to a hospital first or if he died at the scene. It is unclear if anyone else was involved or injured in the incident.

Police at the J. Reuben Long Detention Center are detaining the Ford driver, who has been charged with felony driving under the influence. No information was released regarding the defendant's blood-alcohol content level or when his hearing will take place.

People facing similar circumstances may benefit by retaining a DUI defense attorney. In cases where authorities administered a breath test, a DUI defense attorney representing the defendant might question the calibration of the testing device or if it was properly administered in order to weaken the charges. Moreover, if a blood test was taken, the attorney might challenge the way in which the defendant's blood sample was handled and stored. Through these efforts, the attorney could possibly work to obtain lesser penalties for the defendant, or a judge may decide to dismiss the charges entirely if the attorney is able to sufficiently prove the evidence is inadmissible.
