What is the legal marriage age in South Carolina?

Deciding to marry is a big step, but generally a happy one. Although there is a lot to plan and organize, it is the beginning of a new chapter of your life. As such, there are certain restrictions on who is legally allowed to marry. It is assumed that before a certain age, most people might not be ready for the changes and responsibilities marriage can entail. As such, many states have rules in place governing the age at which you are permitted to marry.

In South Carolina, this age is usually 18, or 16 if you have the permission of a guardian or parent. However, this requires that you live with the person who is to sign the affidavit which permits you to marry. In certain cases, it is possible to marry when below the age of 16, but this is limited to very specific circumstances.

As this article on family law explains, a pregnant girl under the age of 16 may be able to obtain permission to marry the father of the child. However, if the birth has already occurred, she will also need to provide proof from a doctor of her pregnancy. She will also need permission from someone she lives with or from a specified member of Social Services.

If you are considering marriage but are unsure of your rights or what you need to do, an attorney may be able to help you. He or she can explain the laws in your state and advise you about any issues you might need to consider before going ahead with your marriage.
