When should women file for divorce?

South Carolina couples may be interested to learn that most people file for divorce in March and August, according to a study. January is also so popular for divorce that "Divorce Monday" has become a New Year's tradition for many family law firms.

Why are January, March and August so popular? Mostly because these months mark the end of emotional times of the year, such as the holidays, Valentine's Day or summer break. However, divorce experts say the time of year people choose to divorce should be based on financial considerations, not emotional ones. This is especially true of women who are divorcing.

Experts advise women to cover four bases before filing for divorce. First, they should assemble their financial paperwork, including income tax returns, bank financial statements, pensions and wills. This information should be kept in a safety deposit box. Second, women should establish their own credit and bank accounts to lay the foundation for financial independence. Third, they should save enough money to fund a divorce or arrange for a financial advance from a divorce-funding business. Fourth, women should carefully choose a top-notch divorce attorney. Experts recommend interviewing several candidates and choosing one that is trustworthy and respectful. Choosing a divorce financial adviser is also recommended.

South Carolina women facing the end of a marriage may benefit by consulting with a divorce attorney as soon as possible. After reviewing the case, legal counsel could help negotiate agreements for property division, child custody, child support, spousal support and other important divorce legal issues.
