Long-Term Marriages And Marital Property Division

South Carolina is an equitable division state. This means that assets accumulated during the marriage should be divided according to what is fair. In recent cases before the South Carolina Supreme Court, judges have ruled that the starting point should be 50-50 in long-term marriages, particularly those lasting 10 years or longer.

Marital assets include all assets accumulated during the marriage, with the exception of gifts and inheritances. If you owned assets or property before the marriage, those assets are generally yours to keep. However, there are many ways that separate property can become marital property. Here are some examples:

  • You do not have records to prove that you owned the asset before your marriage.

  • You commingled separate assets with marital assets.

  • You placed your spouse's name on the deed of real estate.

  • The asset or property increased in value during your marriage.

Long-Term Marriages And Alimony

The longer your marriage, the more likely judges are to award permanent spousal support or alimony. The purpose of alimony is not to punish wrongdoing, but to help the lower-earning spouse maintain a lifestyle similar to that enjoyed during the marriage.
